1 Legal information

1.1 Warranty for the content of the website

The information on this website is non-binding and is provided for information purposes only. Rotpunkt-Pharma AG accepts no liability for the topicality, correctness, completeness or quality of the information provided, despite the care taken in providing the information on the websites it publishes. Liability claims against Rotpunkt-Pharma AG relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are fundamentally excluded, unless there is evidence of wilful intent or gross negligence on the part of Rotpunkt-Pharma AG. When including links or references on its website, Rotpunkt-Pharma AG checks whether they contain illegal content. 2 Privacy policy

2.1 General information

We attach great importance to respecting your privacy and we attach great importance to protecting your data.

We process data only in accordance with the applicable data protection law. These are in particular the Swiss Federal Data Protection Act of 19 June 1992 and – where applicable – the EU Data Protection Regulation (DSGVO), which came into force on 25 May 2018.

2.2 Scope and purpose of data collection

When you access this website, personal data may be collected. This data protection declaration shows which data is collected and what it is used for.

We would like to point out that data transmission over the internet can generally have security gaps. Guaranteed protection of data against access by third parties cannot be guaranteed.

What is personal data?

Personal data or personal information is any data, such as your name, address or date of birth, that can be used to identify you as a person.

How is data collected on this website?

In principle, it is possible to use this website without providing personal data. We only process data that you send to us, for example by filling out the competition form or when you register for our newsletter.

Other data is automatically collected by our IT systems when you visit the website. This primarily concerns technical data, such as the browser and operating system used or the time when the page is accessed (see ‘Server log files’).

If you apply for a job at a Rotpunkt pharmacy or drugstore, you will need to provide this pharmacy or drugstore with personal data, which may be sensitive. By applying, you give the pharmacy or drugstore your express consent to use this information.

Why is data collected on this website?

The data collected here is used primarily for administrative or communication purposes (such as sending the newsletter or for entering a competition). Data is also collected to ensure that this website is provided without errors and to analyse your user behaviour (see Google Analytics).

What happens to my data?

The data collected about you when you use the website will not be disclosed, sold or otherwise passed on to third parties.

If you enter our competition, your data will be transmitted to our partner (Panta Rhei) in anonymised and aggregated form. The data of the competition winners will be transmitted to the specified Rotpunkt pharmacy and to the issuer of the voucher or prize (e.g. hotels or travel agents) for the purpose of collecting and redeeming the prize. By entering the competition, you consent to this data processing. It is not possible to enter the competition without this data processing.

However, some of our service providers, in particular those involved in the maintenance and servicing of our IT systems, may have access to stored personal data. We keep your personal data for as long as necessary for the purposes for which it is collected and processed.

What rights do you have regarding your data?

You have the right at any time to request and receive information about your personal data stored by Rotpunkt-Pharma AG. You also have the right to have this data corrected or deleted, to request a restriction of the data processing and the right to revoke any consent you have given for the processing of your personal data. To exercise these rights, you can use the contact details provided under ‘Data protection officer and contact’.

3.3 Cookies

We use cookies on our website. Cookies are small files that the website you visit or its server stores on your computer via the browser in order to recognise it again later. We use this data only for statistical evaluations and for the purpose of ensuring operation, increasing security and optimising the offer. However, we reserve the right to check this protocol data retrospectively if we have justified suspicion of unlawful use based on specific indications.

3.6 Competition

If you wish to take part in our competitions, we require personal data from you, such as your name, address, date of birth and email address. We use this data for the purpose of participating in the competition. Your data will be processed exclusively on the basis of your consent (pursuant to Art. 6 para. 1 lit. a DSGVO).

We use your personal data for the purpose of notifying you of a win and for internal statistical analysis. If you take part in our competition, your data will be transmitted to our partner (Panta Rhei) in anonymised and aggregated form for marketing purposes. The data of the competition winners will be transmitted to the specified Rotpunkt pharmacy and to the issuer of the voucher or prize (e.g. hotels or travel agents) for the purpose of collecting and redeeming the prize. 3.7 Newsletter

If you wish to subscribe to our newsletter, we require personal data from you, such as your name or email address. We use this data exclusively for sending the requested information.

Your data will be processed exclusively on the basis of your consent (pursuant to Article 6(1)(a) GDPR). You can unsubscribe from the newsletter at any time, for example by using the ‘Unsubscribe’ link at the end of each newsletter. The data stored for the purpose of sending the newsletter will be deleted after you unsubscribe from the newsletter. This does not affect data that has been collected for a different purpose.

3.8 Campaign Monitor

Our newsletter is sent via the ‘Campaign Monitor’ platform provided by Campaign Monitor, Level 38, 201 Elizabeth Street, Sydney NSW 2000, Australia (www.campaignmonitor.com).

The data (such as name or email address) of our newsletter subscribers is stored on Campaign Monitor servers in Australia, the United States and Germany. Campaign Monitor uses this data on our behalf to send and analyse the newsletter. According to its own statements, Campaign Monitor may also use the data to optimise and improve its own services. However, Campaign Monitor does not contact our newsletter subscribers directly and does not pass on their data to third parties.

3.9 Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (‘Google’), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses ‘cookies’, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States.
